When privately owned land is eroded by water
and becomes part of a waterway,
belonging to the state.
Even if, over time, the land naturally fills back in,
regaining ownership must be done through the legal process
that governs acquisition of property rights.
The original owner cannot simply reclaim it without following the law.
.
Supreme Court Ruling No. 1488/2497 (1947):
If land under title deed is eroded and collapses into the river,
it becomes part of the public waterway.
.
To put it simply:
If you own land adjacent to the sea, rivers, or canals,
and the land is eroded by water
until it becomes part of a natural waterway —
that portion of land
automatically becomes public property.

.
So if you own land next to any body of water,
don’t forget to build a retaining wall
to protect your property
from erosion that could cause you to lose your rights and benefits.
